1. About these terms

1.1 These Terms and Conditions (“Terms“) govern your use of jerkyking.com.au (“Website“) and any purchase of goods from Beyer Pty Ltd ACN 688 361 266, trading as Jerky King and Harvest King (“Jerky King“, “we“, “us“, “our“).

1.2 By placing an order, you agree to these Terms. Please read them before you order. If you do not agree, do not use the Website or place an order.

1.3 These Terms apply to retail purchases made through the Website. Wholesale and trade account customers are supplied under our separate Wholesale Terms of Trade, which prevail over these Terms to the extent of any inconsistency.

1.4 We may change these Terms at any time by posting an updated version on the Website. The Terms in force at the time you place an order apply to that order.

2. Eligibility

2.1 You must be at least 18 years old and able to enter into a legally binding contract to place an order.

2.2 We currently ship within Australia only. Orders with an international delivery address may be cancelled and refunded.

3. Orders

3.1 Product listings on the Website are an invitation to treat, not an offer. Your order is an offer to buy.

3.2 A contract is formed only when we send you a dispatch confirmation email. An order confirmation or payment receipt does not by itself create a contract.

3.3 We may decline or cancel any order before dispatch, including where:

  1. the goods are unavailable or out of stock;
  2. a pricing, description or image error has occurred;
  3. we suspect fraud, misuse of a discount code, or resale of goods bought at retail prices; or
  4. we cannot deliver to your address.

3.4 If we cancel an order you have paid for, we will refund you in full to your original payment method. This does not limit your rights under the Australian Consumer Law.

3.5 Once an order is placed we may not be able to change or cancel it. Contact us immediately at sales@jerkyking.com.au and we will help where we can.

4. Pricing and payment

4.1 All prices are in Australian dollars (AUD) and include GST unless stated otherwise.

4.2 Prices exclude delivery charges, which are shown at checkout before you pay.

4.3 We may change prices at any time. Price changes do not affect orders already confirmed for dispatch.

4.4 Payment must be made in full at the time of ordering. We accept the payment methods shown at checkout.

4.5 Payments are processed by third party payment providers. We do not store your full card details. Your use of a payment provider is subject to that provider’s own terms.

4.6 If a payment is reversed, charged back or dishonoured, we may suspend or cancel your order and recover any resulting costs from you.

5. Errors

5.1 We take care with pricing and descriptions but errors happen. If we discover an error in the price or description of goods you have ordered, we will contact you and give you the option to proceed at the correct price or cancel for a full refund.

6. Delivery, risk and title

6.1 Delivery is covered by our Shipping and Returns Policy, which forms part of these Terms.

6.2 Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by carriers, weather, or events outside our reasonable control.

6.3 Risk in the goods passes to you on delivery to the address you nominate.

6.4 Title in the goods passes to you when we receive payment in full.

6.5 If you authorise an “authority to leave” or unattended delivery, risk passes when the goods are left at the address, and we are not responsible for loss, theft, or heat damage after that point.

6.6 You must provide a correct and complete delivery address. We are not responsible for goods delivered to an incorrect address supplied by you, and re-delivery may incur a further charge.

7. Food products, allergens and storage

7.1 Our products are food products containing beef, nuts, and other ingredients. Products are manufactured in facilities that handle nuts, soy, wheat/gluten, sesame and other allergens. We cannot guarantee that any product is free from traces of allergens.

7.2 It is your responsibility to read the ingredient and allergen information on the product packaging before consuming. If you have a food allergy, intolerance, or medical condition, check the packaging and consult your doctor. Do not rely solely on Website descriptions.

7.3 Website product descriptions, images and nutritional information are provided in good faith as a general guide. The information on the physical packaging prevails.

7.4 You must store products in accordance with the storage instructions on the packaging and consume them by the best before date shown.

7.5 Product recipes, packaging and ingredients may change. Always check the current packaging.

8. Australian Consumer Law

8.1 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (“ACL”) or any other law that cannot lawfully be excluded.

8.2 Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8.3 Where we are permitted to limit our liability for a breach of a consumer guarantee, our liability is limited, at our option, to:

  1. replacing the goods or supplying equivalent goods;
  2. repairing the goods;
  3. paying the cost of replacing the goods or acquiring equivalent goods; or
  4. paying the cost of having the goods repaired.

9. Limitation of liability

9.1 Subject to clause 8, and to the maximum extent permitted by law:

  1. our total aggregate liability to you arising out of or in connection with an order is limited to the amount you paid for the goods giving rise to the claim; and
  2. we are not liable for any indirect, special, incidental or consequential loss, or for loss of profit, revenue, business, goodwill, or anticipated savings.

9.2 We do not warrant that the Website will be uninterrupted, error free, or free of viruses or harmful components.

9.3 Nothing in this clause limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited at law.

10. Intellectual property

10.1 All content on the Website, including the “Jerky King” and “Harvest King” names and logos, text, images, packaging designs, and product photography, is owned by or licensed to Jerky King and protected by law.

10.2 You may view and print Website content for your own personal, non-commercial use. You must not copy, reproduce, republish, modify, or use our content or trade marks for commercial purposes without our prior written consent.

11. Your conduct

11.1 You must not use the Website to:

  1. breach any law;
  2. transmit any harmful code or attempt to gain unauthorised access to our systems;
  3. scrape, harvest or systematically extract data; or
  4. post false, misleading, defamatory or offensive content in any review or submission.

11.2 If you submit a review, photo, or other content to us or our social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for marketing purposes.

12. Resale and stockists

12.1 Goods purchased through the Website are for personal consumption or gifting only. You must not resell Website purchases in the course of a business without our written consent.

12.2 If you wish to stock Jerky King products, contact sales@jerkyking.com.au. Trade supply is governed by our Wholesale Terms of Trade.

13. Privacy

13.1 We handle your personal information in accordance with our Privacy Policy, available on the Website.

14. Third party links

14.1 The Website may contain links to third party websites. We do not control those sites and are not responsible for their content, products, or privacy practices.

15. Force majeure

15.1 We are not liable for any failure or delay in performing our obligations where that failure or delay is caused by an event beyond our reasonable control, including natural disaster, flood, fire, pandemic, industrial action, supply chain failure, carrier failure, or government action.

16. General

16.1 Governing law. These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.

16.2 Severance. If any part of these Terms is found to be unenforceable, that part is severed and the rest continues to apply.

16.3 Waiver. A failure by us to enforce any provision is not a waiver of that provision.

16.4 Entire agreement. These Terms, together with our Shipping and Returns Policy and Privacy Policy, form the entire agreement between us regarding Website purchases.
