1.1 Beyer Pty Ltd ACN 688 361 266, trading as Jerky King and Harvest King (“Jerky King“, “we“, “us“, “our“) respects your privacy. This Policy explains how we collect, hold, use and disclose personal information, and how you can access, correct or complain about our handling of it.
1.2 We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1.3 By using our website jerkyking.com.au (“Website“), placing an order, or dealing with us, you consent to this Policy.
2. What personal information we collect
We collect personal information that is reasonably necessary for our business functions. This may include:
Customers and website visitors
- name;
- email address, phone number;
- delivery and billing address;
- order history and product preferences;
- payment information (processed by our payment providers — we do not store your full card number);
- correspondence with us, including emails, contact form submissions and social media messages;
- reviews, photos and other content you submit.
Trade and wholesale customers
- business name, ABN/ACN, trading address;
- names, positions and contact details of directors, proprietors, guarantors and accounts staff;
- trade references and bank details;
- credit history, credit reporting information, and payment conduct information.
Job applicants
- résumé, employment and education history, and referee details.
Technical information
- IP address, browser type, device type, operating system;
- pages visited, time on site, referring website;
- cookie and analytics data (see clause 8).
Sensitive information
We generally do not collect sensitive information. If you tell us about an allergy or dietary requirement, that is health information and we will only use it to respond to your enquiry or order.
Anonymity
You may deal with us anonymously or by pseudonym where it is lawful and practicable — for example, when making a general enquiry. We cannot process and deliver an order anonymously.
3. How we collect personal information
We collect personal information:
- directly from you — when you place an order, create an account, subscribe to our mailing list, complete a credit application, contact us, or engage with us on social media;
- automatically — through cookies and analytics tools when you use the Website;
- from third parties — including our payment processors, freight and delivery partners, credit reporting bodies, trade references, and publicly available sources such as ASIC and ABN Lookup.
Where we collect your information from a third party, we will take reasonable steps to make you aware of that collection unless it is impracticable or unreasonable to do so.
4. Why we collect, hold and use personal information
We use personal information to:
- process, fulfil and deliver your orders;
- take payment and manage refunds;
- communicate with you about your order or enquiry;
- assess applications for a trade credit account and manage that account;
- monitor and collect payment of amounts owed to us, including referring overdue accounts to debt collection agents, credit reporting bodies or lawyers;
- provide customer support and handle complaints, including product safety and recall matters;
- send you marketing about our products, offers and news (see clause 5);
- improve our products, Website and customer experience;
- maintain our business records and comply with our legal obligations, including under food safety, tax and consumer laws;
- prevent fraud and misuse of the Website.
If you do not provide the personal information we ask for, we may not be able to supply goods to you, open a credit account, or respond to your enquiry.
5. Direct marketing
5.1 We may send you marketing communications by email or SMS about our products, promotions and news, where you have consented or where you would reasonably expect to receive them.
5.2 Every marketing message includes an unsubscribe option. You can opt out at any time by clicking unsubscribe, replying STOP, or emailing sales@jerkyking.com.au. We will action your request promptly.
5.3 We comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
5.4 We do not sell your personal information, and we do not disclose it to other organisations for their own direct marketing purposes.
6. Who we disclose personal information to
We may disclose personal information to:
- service providers who help us run our business — website hosting, ecommerce platform, email and marketing platforms, IT support, analytics providers, and cloud storage;
- payment processors and financial institutions to take and reconcile payment;
- freight, courier and logistics providers to deliver your order;
- debt collection agencies, credit reporting bodies, credit providers and lawyers where an account is overdue or where we are assessing a credit application;
- our professional advisers — accountants, auditors and insurers;
- government agencies, regulators, courts and law enforcement where required or authorised by law, including food safety authorities in a recall;
- a purchaser or prospective purchaser of our business or assets;
- any person you have authorised us to disclose it to.
We require our service providers to protect personal information and to use it only for the purpose we engaged them for.
7. Overseas disclosure
7.1 Some of our service providers store or process data outside Australia. Depending on the providers we use from time to time, this may include the United States, the European Union, Singapore and the United Kingdom.
7.2 Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles. However, we may not be able to control how overseas recipients handle personal information, and overseas laws may differ from Australian privacy laws.
8. Cookies and website analytics
8.1 The Website uses cookies — small data files stored on your device. We use them to keep your shopping cart working, remember your preferences, and understand how the Website is used.
8.2 We use Google Analytics and Google Site Kit to collect anonymous statistics about Website use. Google may store this data overseas. You can opt out using the Google Analytics Opt-out Browser Add-on at https://tools.google.com/dlpage/gaoptout.
8.3 We may use advertising and remarketing tools, including Meta (Facebook) tools, to show you our ads on other platforms.
8.4 You can disable cookies in your browser settings, but parts of the Website — including the shopping cart and checkout — may not work correctly.
9. Security and storage
9.1 We hold personal information in electronic form on secure systems operated by us and our service providers, and in paper form where relevant.
9.2 We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These include access controls, password protection, secure hosting, and encrypted connections (HTTPS).
9.3 No method of transmission over the internet is completely secure. You transmit information to us at your own risk.
9.4 We retain personal information for as long as needed for the purposes described in this Policy and to meet our legal record-keeping obligations (for example, tax records must generally be kept for 5 years). When it is no longer required, we take reasonable steps to destroy it or de-identify it.
10. Data breaches
10.1 We have procedures in place to respond to suspected data breaches. If a data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.
11. Accessing and correcting your information
11.1 You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading.
11.2 Send your request to sales@jerkyking.com.au. We may ask you to verify your identity.
11.3 We will respond within a reasonable period, and generally within 30 days. Access is free, though we may charge a reasonable fee for the cost of supplying the information in some cases.
11.4 We may refuse access or correction in limited circumstances permitted by the Privacy Act. If we do, we will tell you in writing why and how you can complain.
